When you do business abroad there is always risk involved, but in China this risk seems higher. Unfortunately, experience shows that scams and deception seem to be more the rule than the exception. Products are delivered of lower quality or late. You prefer to avoid these types of situations and can largely be limited.
Most problems arise when payment is made in advance to the Chinese party. Goods are often delivered on time, but are not in accordance with the contract. Brokers are often responsible for such practices and disappear into thin air after the money is in the account.
Limit risk
The euphoria of a good deal can prevent basic steps from being skipped, but with a number of basic steps you can significantly reduce the risk.
- Always check the official documents of your Chinese business partner
- Draw up a Chinese contract to which Chinese law applies
- Know who has decision-making authority and check who has authority to sign a contract
- Work with a reliable local intermediary if you cannot be in China yourself
- Important documents have a company stamp from your Chinese business partner
- Register your trademark in English and Chinese
When things go wrong
It is very annoying when things do go wrong, fortunately not everything is lost immediately. If you immediately threaten to go to court or the police, you close the door to a possible solution. In addition, in most cases you will not win in the Chinese court and the police will not help you if you do not have a complete file with original documents.
